WAIVER, ASSUMPTION OF RISK AND TERMS OF USE AGREEMENT

By selecting “I Agree,” checking any acceptance box, downloading, accessing, or using any routes, GPS tracks, maps, website, mobile application, or related digital content and services (collectively, the “Services”) provided by Adventure Routes Canada (“ARC”), you acknowledge that you have read, understood, and voluntarily agree to be legally bound by this waiver and agreement. If you do not agree, you must not access or use the Services.
Nature of Services: You understand and agree that the Services provide general outdoor navigation and recreational information only and are not guaranteed to be accurate, complete, reliable, or current. The Services are informational tools and are not a substitute for personal judgment, preparation, skill, experience, route planning, or situational awareness. Real-world conditions, including terrain, land access, weather, hazards, closures, traffic, water levels, wildlife, mechanical issues, and other unforeseen dangers, may change at any time and may differ substantially from any digital information provided.
Assumption of Risks: You expressly acknowledge that outdoor travel and motorized or non-motorized recreation involve inherent and significant risks, including but not limited to personal injury, illness, death, property damage, equipment failure, navigation error, collision, remoteness from medical care, changing environmental conditions, and the actions of other persons. You voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with use of the Services.
You accept full responsibility for your safety, decisions, actions, equipment, training, preparedness, route selection, and compliance with all applicable laws and land use regulations. You agree that you will independently assess conditions, carry appropriate safety and navigation equipment, maintain backup navigation methods, and exercise personal judgment at all times. Your use of the Services is entirely at your own risk.
No Professional Advice: You understand the Services do not provide professional advice of any kind, including safety, technical, mechanical, medical, or legal advice, and Adventure Routes Canada does not act as a guide, instructor, outfitter, safety authority, or professional advisor.
Accuracy and Availability: While efforts may be made to provide useful information, no representation is made that routes, tracks, mapping data, or descriptions reflect current conditions or are free from errors or omissions, nor that the Services will be available, continuous, secure, or uninterrupted. Adventure Routes Canada has no obligation to update, correct, or maintain any content.
Disclaimer of Warranties: To the fullest extent permitted by the laws of Canada and the Province of Ontario, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, merchantability, reliability, availability, or non-infringement.
Release of Liability: You hereby release, waive, and forever discharge Adventure Routes Canada and its directors, officers, volunteers, contributors, partners, licensors, and affiliates from any and all claims, demands, damages, losses, liabilities, costs, or expenses of any kind arising from or related to your use of, reliance upon, or inability to use the Services, including but not limited to personal injury, death, property damage, loss of data, loss of enjoyment, or economic loss, whether based in contract, negligence, tort, statute, or otherwise, even if caused by ordinary negligence. If liability is found despite this waiver, you agree that the total liability shall not exceed any fee paid by you, if any, to access the Services.
Third-Party Data: You acknowledge that portions of the Services may rely upon third-party data, systems, mapping platforms, or technology, and you agree that Adventure Routes Canada is not responsible for inaccuracies, outages, delays, failures, or interruptions caused by third parties.
Intellectual Property and Usage: You agree to use the Services solely for personal, non-commercial purposes and not to sell, license, distribute, publish, reproduce, copy, modify, reverse engineer, extract data from, create derivative works from, or otherwise exploit the content, routes, or GPS data. All content, trademarks, routes, tracks, and materials remain the exclusive property of Adventure Routes Canada or its licensors, and no ownership rights are transferred to you. Unauthorized use may result in suspension or termination of access without notice.
Termination: Adventure Routes Canada may suspend or terminate access to the Services at any time, including where misuse is suspected, these terms are violated, or the Services are discontinued.
Governing Law: This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from or relating to this agreement or the Services shall be brought exclusively before the courts of Ontario, Canada. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect. This document constitutes the entire agreement between you and Adventure Routes Canada regarding the Services and supersedes all prior understandings or agreements.
By agreeing, you confirm that you understand you are giving up certain legal rights, including the right to sue, and that you accept this agreement voluntarily.
